NEWS: Montgomery misses court
A special prosecutor wants to know whether City Councilor Joel Montgomery participated in any sort of counciling or drug rehabilitation program, but today the councilor failed to show for a court hearing on the matter. In August, special prosecutor Don Colee dropped a public intoxication charge against Montgomery with the understanding that Montgomery would seek some sort of treatment.
A week later, Montgomery announced in a Birmingham City Council meeting that he had not been to rehab, nor was he going to go to rehab.
In April, police found Montgomery bloodied and disoriented in a Five Points South parking lot. Accoring to the police report, Montgomery was beligerent toward police officers, cussing at them and making lewd comments toward a female officer. He was arrested for public intoxication. He refused medical treatment at Cooper Green Mercy Hospital before he was booked, according to the police report.
Montgomery’s defense attorney, Tommy Spina, has said that the councilor stumbled over a wall in the parking lot and that he was disoriented by the fall.
