Larry Langford’s home out of range

On the corner of Fair Oaks Drive and Earlwood Road in Fairfield, Ala., there is a house. It’s larger than most around it but not out of character with the neighborhood. A one-story with a couple of apparent expansions, it is cut from that post-WWII architectural style most people just call “ranch.” The owner has adorned one exterior wall with three illuminated white crosses, affixed just beneath the apex of the roof. Other than that, not much else distinguishes it from the houses around it, except for one other little fact.

This house is the home of Birmingham Mayor Larry Langford. 

The issue of Mayor Langford’s residency is not a new one. It’s an old joke that no one laughs at anymore. But just to belabor the point, I conscripted one of Birmingham Weekly’s contributing writers, Madison Underwood, for a little project. Periodically we would wake up just before sunrise and drive from Birmingham (where we both live) to Fairfield. We’d navigate the Fair Oaks subdivision to Larry Langford’s house to see if his car was parked in the driveway. We’d shoot video. We’d take pictures. And we’d do this enough times until a reasonable person could conclude that Langford still lived there and there alone.

On the morning of March 13, the Escalade was parked in the driveway.

Immediately after Langford won the 2007 mayoral election, one of his rivals, attorney Patrick Cooper, challenged his qualification for the office on the basis of residency. Cooper contended that Langford never moved to Birmingham, even though Langford had rented an apartment downtown and changed his voter registration to that address. The lawsuit went before Circuit Judge Allwin Horn. In court, Cooper’s attorney produced evidence that Langford still lived in Fairfield, including utility bills, tax records and Langford’s own testimony. At the time, Langford told the court that he typically spent three to four nights per week in each location – the downtown apartment and his Fairfield home.

Cooper’s lawyer argued that in order to establish a new residence first you must abandon your old one. Langford testified that if someone walked into his Fairfield house, they would conclude that someone lived there. He had not abandoned it. However, Judge Horn was reluctant to overturn an election. He ruled that residency is largely a matter of intent. Since Langford testified that he intended to move to Birmingham, then he could legally qualify as a resident here.

On the morning of March 20, the Escalade was parked in the driveway.

A year and a half later, though, we have one benefit Judge Horn lacked when he made his ruling – hindsight. We don’t have to rely on Langford’s testimony about his intent because we now have something else with which to compare it. We have his behavior – his actual actions. Actions speak louder than words, even if those words were given under penalty of perjury.

Just for math geeks out there, lets assume Langford was telling the truth when he said he split his time evenly between the two addresses. That means that if you drove to Fairfield once, you’d have a 50 percent chance of seeing his car in his driveway. Every trip after that, the odds of catching him every time are cut in half, so the chances for catching him there twice in a row would be 25 percent. Five times in a row? The odds of that would be slightly more than three percent – the equivalent of flipping a coin five times and landing on all heads – if Langford was telling the truth.

 

On the morning of April 6, the Escalade was parked in the driveway.

When Langford was arrested on public corruption charges last year, he had to give one and only one address to the federal probation office. At his initial appearance, the federal magistrate told Langford in very clear terms that if he were found living at any other address he would be in violation of his release and could go straight to jail. That probation record is not a public document, but let’s assume Langford wrote on it one of two addresses. If he wrote that he lived in Birmingham, then by living in Fairfield, he is violating his probation. If he wrote that he lived in Fairfield, then he is not a Birmingham resident and is not legally mayor.

On the morning of April 15, the Escalade was parked in the driveway.

It’s clear that Langford still lives in Fairfield and never moved to Birmingham. Again, this isn’t new, but what’s so astonishing is that it’s not news.

I’m not proud of our little project. I’m ashamed I took so long to do it and I’m saddened that no one beat us to it.

For television or newspapers, this is an easy story to do, and it’s at least as newsworthy as half the stuff you see on any of the nightly broadcasts. If some poor sucker gets ripped off buying the wrong kind of aluminum siding, Fox 6 “On Your Side” will climb up the salesman’s back, but if Larry Langford is illegally mayor and possibly guilty of perjury, every TV photographer will chuck his camera in the river before making that trip to Fairfield.

 ”I’m sick and tired of people who live outside the city telling us what we can and cannot do,” Langford said at a townhall meeting more than a year ago. Since then he’s repeated that line often, but except for one cartoon by Scott Stantis and a few smug comments from John Archibald, when has The Birmingham News called Langford out on his obvious hypocrisy?

If the Birmingham Post-Herald were still around, there’s no way a story like this would have gone unreported, but this the reality of living in a one-newspaper town and the reason we risk soon living in a no-newspaper town.

Finally, all of this is indicative of something significant about Birmingham. Even the mayor’s fiercest enemies won’t exploit an obvious vulnerability. The mayor doesn’t live here, and while lots of people grouse and groan about it, not one person in this whole town has the initiative to file a lawsuit challenging Langford’s claim to the office. Birmingham has so little self-respect that no one cares anymore if even the mayor lives here.

    thank you, Thank You, THANK YOU for holding Bham's leaders accountable when no one else seems to be. When none of the TV stations are willing to spend the time necessary to expose Langford for what he is, you are relentless. Kudos for doing what needs to be done when no one else is willing to be uncomfortable or go the extra mile to get the story. THANK YOU!!!

    great job. It's a shame that the local news is seemingly so beholden to the mayor that they don't have the guts to pursue such an obvious story....

    I've asked the mayor and so have others, although it has been awhile. When I did, he demanded to know why it was any of my business. When I asked if that was his answer, he insisted it was none of my business. This was in front of other reporters, no less. I'm not the only reporter this has happened to or the only one who has witnessed this, but I'm the only one that I know of who has reported it.

    Beyond a certain point, though, it doesn't matter. He was asked directly about this in court under oath, and he didn't tell the truth then, either. There aren't two sides of this story. As Bernard Kincaid used to say, "res ipsa loquitur." It's a Latin term used in law. It means, roughly, "the thing speaks for itself."
  • I think it would've strengthened your column to ask how many nights a week he spends at his Birmingham residence, and if he hadn't already, if he intended to follow through on his promise to move to Birmingham.

    I'm not sure it's a vulnerability anyway. Calling an elected official out on lying or breaking a promise isn't anything new, and residency isn't a requirement of the mayor's office (if I remember correctly).

    Ultimately, though, this column isn't so much about Langford, and that's why that last line is there. It's about Birmingham. If no one in Birmingham cares that Langford doesn't live here, then it really is the dead issue the mayor and his supporters want it to be and this will be the last that comes of it. He wins.
  • I don't buy it.

    As a journalist, you're making allegations against a public official. The very least thing you could've done is called or knocked on the door for a response. Even if it was the same question for the 100th time.

    You call out other media for not doing a better job. But you must also set the example you want others to follow.

    For example, let's say you don't like the hit-and-run commentary coverage on 24-hour cable news. Does this column fall within the same category? Is it fair?

    We certainly could have done that, but I have hope that this bit of reporting will bring the question of the Mayor's residency to the forefront, where it does belong. The legitimacy of our elections is important, at least to me.

    And I would defend this reporting--I think it is a valuable piece of investigation on an issue that is inexplicably paid little attention. (I'm a bit biased in favor of my own work, of course)

    The remark about Langford's wardrobe seemed to be little more than a stab at reminding everyone about the mayor's embarrassing clothing bills.

    As someone who knows the mayor from a professional standpoint, I can tell you that his love for cars and clothes is greatly surpassed by his love of music. He is an audiophile of the highest order, with specially-calibrated surround-sound equipment, and the specialty CDs to match.

    An inquiry such as this that does NOT reach out to Langford for comment, while erroneously assuming knowledge of his passions and preferences loses much in credibility.

    Which in turn dilutes the power of the question: where do you really live?

    The mayor is required to be a citizen of the city in which s/he is mayor. Quoting the Mayor/Council Act in the Code of General Ordinances City of Birmingham, Alabama:

    "Any person desiring to become a candidate at any election for the office of mayor may become such candidate by filing in the office of the Judge of Probate of the county in which such city is situated, a statement in writing of such candidacy, accompanied by an affidavit taken and certified by such judge of probate or by a notary public that such person is duly qualified to hold the office for which he desires to be a candidate. Such statement shall be filed at lease 21 days before the day set for such election, and shall be in substantially the following form: 'State of Alabama, _____ County. I, the undersigned, being first duly sworn, depose and say that I am a citizen of the City of _______, in said State and County, and reside at _____ in said City of _____...'" etc.
  • The first few visits were all on the same day of the week, so I'm not sure that's a reasonable statistical sample to glean anything concrete.

  • Kyle, kudos to you and Madison for sticking with this story. You make an excellent point about the requirement that Langford give one address only to the federal probation office. It's a shame that document isn't public information, but it certainly could be subpoenaed if a Birmingham resident (or group of residents) did decide to sue.

    While I can understand the reluctance of private citizens to get involved in a costly and time-consuming court proceeding, I can't fathom the "don't rock the boat" attitude that seems to have infected most of the press. Here we have yet another example of Langford's staunch belief that the rules don't apply to him, and we're letting him get away with it. Is the Birmingham News waiting for the federal trial to take care of this problem?

    After the initial giggle at the gotcha (yes, great music), sober thoughts took over. If Birmingham residents don't care, we are in even worse trouble, because it was also pointed out earlier this morning at a civic meeting that the Mayor is working to diminish citizen participation, which is already too low.

    Birmingham residents, let's get more people involved and paying attention. You can start by helping to set a citizens' agenda for the council elections.

    I saw that. I wonder if there is a way to determine the date of that photo. I ask because when I first looked up his address in 2007, I looked at the house on Google Maps. The car wasn't there then. It is now. Hmmmmm.

    Hm. I assumed it was relatively new, not knowing how long he'd had a big black SUV. According to the information on Google Earth, the imagery dates to March 2002, so it's irrelevant.

    Kudos to Kyle for doing what appears no one else is willing to do. At the very least, he is unwilling to do what many if not all of our citizens have done -- ignore it. Wade, I can appreciate your dedication to journalistic integrity. Maybe if you two were to join forces, two rights can make a left. I do believe that something is better than nothing, which is what the rest of us are all guilty of (not) doing.
  • Well, the fact is that the people of Birmingham elected him, his abnormalities and ideas, to be in charge of the city and get it where they believe it should be. He has been a favorite for decades. The people want him in office. These kinds of attacks come across very negatively. We know you guys don't favor him but come on guys. He at least needs the opportunity to explain. If he lived in Kalamazoo, Michigan the people would probably still vote for him. His residence is not their issue.

    Langford's merely continuing the century-old tradition of Birmingham, Jefferson County and much of Alabama. Namely office holders who perpetuate ruinous corruption, ego-driven decision-making, and self-righteous violations of the laws of man, Common Sense and the strictures of the Bible.

    Langford is just another personification of all that is wrong with this place...and all of us who do nothing but complain about him and his ilk.
    At least he makes the garbage pick-ups run on time. Now, we need a Reform Movement to remove our political garbage.

    He also has a really nice Cadillac 2-door sporty looking car. Not sure which Caddy it is - dont really care; personally I think it's tacky. But I think it stays in the garage. I agree with you totally. So, why isn't he held accountable?

    It's the responsibility of anyone who lives within the city limits and believes in the rule of law (and who prefer that the people Birmingham elects elect to live in Birmingham).

    There would likely be an issue of motive if Kyle or I filed the suit, though. Larry's lawyers could say that we're simply trying to gin up a story, and since we'd obviously want to cover the lawsuit as news, they might be right.

    FANTASTIC REPORTING! But face it, the once-promising great city is dead like most big U.S., Democrat/Socialist/Statist-run welfare-state cities. Birmingham is a shithole with prison schools run by semi-retarded, Tammany-Hall-patronage, ignorant assholes. They are in it for the clothes and cars that their intellect will not allow them to obtain in the private marketplace. They are not in it for civic duty or betterment. They LIE and say they are, but they are just liars and shills. Birmingham is fast becoming like the old Tina Turner movie, "Thunderdome" a/k/a Detroit. No, no one does care about it. That is why anyone with any sense lives outside the dump. They have taxed and stolen most business and civic-minded citizens out of there. The U.S. Government is on the same path now. If Birmingham wants that joke, Mickey Mouse amatuer sludge for a Mayor who cares? It's their baby. Let them live with it and die with it.

    The extent and depth of corruption goes too deep and has been in process
    for far too long for immediate or lasting remedy. One is reminded of how
    it is that a single bad-apple will eventually spoil an entire barrel of apples.
    Whatever may be the process or means of emptying the barrel of its rot
    will not come because it cannot come, readily. To the poster's mind; the
    sordid ethno-political synergies have, for too long, been pervasive.

    The conviction, here, holds that empting the barrel of it's corrupted and
    corrupting influences will, because it must, come from sources socially
    and ethically alien to those which for, so long, have held sway at county-
    city centre; the poster sees no other way except from authoratative and

    Look im just gonna say what no one else will, Langford was stuck in office because of one thing....he was in the pockets of black church leaders and for that reason alone. Patrick Cooper was easily the smarter candidate, hell we just hired a President with practically the exact same feel. Second we are never going to be able to hold political officials accountable for their actions until we can hold Judges accountable for their actions. If they make a decision knowing the facts like in that trial or with George Bush they should be stripped of every robe they own. Third "Wadeonbirmingham" what your doing to these 2 good journalists is EVERYTHING that is wrong with society today. You cant Justice because of people like you.Who really gives a crap if this man knocked on the door or made a phone call to which everyone who has a lil thing called Common Sence would know what was going to happen, either a closed door or a phone call ending with "its none of yoru business." Its people like you who pick at the fabric of truth over and over until eventually when your done with it the point of the matter or truth of it no longer matters because the otherside is having to deal with whether or not they knocked on the door...not whether or not the mans car that he uses everyday is at a residence that is not in the city in which he is a mayor.

    While I agree with Wade -- and knowing a little about journalism, TrueEyes, well practiced journalism brings the truth to the forefront, not ... well, whatever you suggest that Wade is doing. I honestly can't pinpoint what you're trying to say. -- I think that Kyle and Madison have done a good thing here, by at least trying to bring it back to the forefront. I would even suggest taking it one step further, by calling Fox 6 and asking them to do an "On Your Side" follow up.

    Langford is, from what I've seen, one of the premiere examples of everything that is wrong with politicians (and, by extension, humanity) today. He seems entirely out for personal gain, and almost at times appears to take actions for the same that border on sociopathic. He's been elected to serve the people of Birmingham, and yet displays utter disregard for those people when it's a question of his well-being versus theirs.

    I'm glad that I don't live in Birmingham, even if I do still work here (the only reason I could come up with -- to be the one that filed the lawsuit -- is nullified by the fact that my name has been on the BW masthead for some eight or nine years, putting me in the same category as Kyle and Madison). It's bad enough that Jefferson County (where I still reside) is making federal news for the sewer mess, but Langford has probably done more to embarrass the city than anyone in decades.

    The sad thing is that I agree with a lot of his (stated) politics; don't confuse this as any sort of feeling that stems from ideological concerns. It's the lying, (alleged) criminality, and petty and selfish (and, sadly, very public) behaviors that are so poorly reflective of this city.

I just mean, i think their are other people out there in the world who think that you shouldn't give an old lady millions of dollars because she bought coffee...spilled it on herself...and because it didnt say HOT...she wins millions of dollars. You just sort of seem like that lawyer who is telling the woman to sue because it didnt say HOT wade. I understand your questions to kyle and madison....but i also think they are unneccasary. "Did youa sk Mayor Langford for comment?" Wade writes. What do you think hes gonna comment..."Of course i dont live in fairfield"....or "Its none of your business"........why waste tv, newspaper, radio time with crap like that...we already knew that. So dont take it so personal Wade. Remember, this is a War on Dumb!

    I'd love to know Mayor Langford's response. Certainly I am not as intuitive as other readers out there to know what's on his mind before the question is asked.

    Someday, you may be profiled in the media. Would you rather have a chance to comment or not? Fairness leads to better credibility.

    Im not gonna play word wars with you, you know what I mean, and to be honest I dont care enough about you to attack you. Facts are facts and its exactly your mentality that has 90% of news on tv of stuff we didnt have to watch to already know. And btw thank god im intuitive enough to know that Larry Langford would say those things....common sence. The only reason to actually ask is to fulfill the needs of folks like you you nitpick at the fabric of justice until the issue no longer matters and all that is left is whether or not someone knocked on the guys door rather than whether or not he lives there. Im no fool, your not either....dont be a silver tounged drama queen wade!

    Larry Langford struts about like a little Banty Rooster, crowing at the top of his lungs. When anyone disagrees with him, he crows and runs from the room. It is all very childish. His inability to tell the truth about his legal residence is not at all surprising, it is merely another falsehood perpetuated by another failed so called public servant .
